1. Definitions

"Platform": the multi-mode interaction service provided under the name PerguntaMe. "Operator": João Leão, trading as Aequorea Victoria. "User": any person who accesses the PerguntaMe platform. "Personal Data": any information relating to an identified or identifiable natural person under GDPR. "KnowMe Mode": the feature that matches users based on shared topics and intimacy levels. "Data Controller": João Leão, responsible for the processing of your data.

2. Acceptance of Terms

By accessing or using PerguntaMe, you agree to be bound by these Terms and our Privacy Policy. These terms constitute a legal agreement between you and the Operator. If you do not agree, you must cease use of the platform immediately.

3. Age Requirement & Eligibility

You must be at least 18 years of age to create an account or use 'KnowMe' and 'Sweet & Spicy' modes. By using these features, you represent and warrant that you have the legal capacity to enter into this agreement. The Operator reserves the right to terminate accounts of users suspected of being under the required age.

4. Account Security & Profile Authenticity

Users are responsible for maintaining the confidentiality of their credentials. You agree to provide accurate information. Profile pictures must represent the user, be non-offensive, and not infringe on third-party intellectual property or personality rights. Impersonation of others is strictly prohibited.

5. KnowMe & Matching Dynamics

KnowMe is a social discovery tool. By using it, you acknowledge: (a) Your profile picture and name will be displayed to potential matches; (b) Matching is based on automated processing of your 'vibes' and preferences; (c) Conversation history is stored to provide continuity. While the Operator facilitates connections, no criminal background checks are performed on users. Caution is advised when sharing personal information.

6. Data Storage & Retention

We store Game Data and Conversation History to ensure your history is accessible across devices. If you delete your account, your personal data will be purged or anonymized within 30 days, except where legal obligations require longer retention. You explicitly consent to the storage of chat logs for the purpose of maintaining conversation continuity.

7. User Conduct & Zero-Tolerance Policy

Harassment, hate speech, or solicitation are strictly prohibited. PerguntaMe is a platform for meaningful connection. The Operator reserves the right to use automated and manual moderation. Any violation leads to a permanent ban from the PerguntaMe/Aequorea Victoria ecosystem, affecting all current and future products.

8. Intellectual Property

The 'PerguntaMe' brand, the 'KnowMe' algorithm, the question sets, and the visual interface are the exclusive intellectual property of João Leão. Users are granted a limited, personal, non-commercial license to use the platform. Reproduction of content for commercial use is strictly prohibited.

9. Privacy & GDPR Rights

In accordance with the GDPR, you have the right to access, rectify, or request erasure of your data. As a personal project, the Operator acts as the Data Controller. We use cookies for essential functions and, with your consent, for analytics. Please refer to our full Privacy Policy for details.

10. Cookies & Tracking

We use essential cookies to maintain your session. Analytical cookies (e.g., Google Analytics) are used only with your explicit consent via our cookie banner to help the Operator improve the platform experience.

11. Limitation of Liability

To the maximum extent permitted by law, the Operator (João Leão) shall not be liable for any damages arising from: (a) User-generated content; (b) Offline interactions between users; (c) Unauthorized access to your account. The platform is provided 'as is' for entertainment and social purposes without any express or implied warranties.

12. Social vs. Dating Disclaimer

PerguntaMe is designed for social connection and deep conversation. While relationships may form, the platform is not a 'Dating App.' The Operator is not responsible for the outcome of any romantic or personal connections made through the platform.

13. Governing Law

These terms are governed by the laws of Portugal. Any disputes shall be subject to the exclusive jurisdiction of the courts of Lisbon, Portugal.
